For the nice aspect of the FLA, you could also resize the stage to the size you know you'll need it at. :-)

There are two layers only. One of them says: shadow [delete this layer]. Delete it.
On the second layer called mcNewsletter, you have the movieclip which is called the same way: mcNewsletter. Move that to 0x0.
That's it. Recompile the swf (CTRL+ENTER) and you have no background now. It's quite easy to get around this with no Flash experience.
The resize is done through XML or HTML, depending where you plan to use the file. As I presume you use it inside an HTML website, you will do it by editing the values in the XML.

but when i delete the background layer, move the element to upper corner 0x0, it somehow gets buggy and out of line the element, the text form box is out of positison
